1. Acceptance
By installing or using BrainRot Factory, you agree to these terms. If you do not agree, do not use the app.
2. The service
BrainRot Factory is a mobile app that generates short videos from user input using AI services. The app is provided as is. We do not guarantee uptime, output quality, or accuracy.
3. Eligibility
You must be at least 13 years old to use the app. By using it, you represent that you are at least 13 and have the legal capacity to enter this agreement.
4. Your content
You retain ownership of any text, files, or URLs you provide as input. You also own the videos generated for you.
By submitting input, you grant us a non-exclusive, worldwide, royalty-free licence to process the input through the AI pipeline, deliver the output, and run moderation on inputs and outputs.
You are responsible for ensuring you have the right to use any input you provide. Do not submit copyrighted text or files you do not own or have permission to use, content that violates someone's privacy, or content that targets a real individual or group for harassment.
5. Acceptable use
You agree not to use the app to generate sexual content involving minors, detailed instructions for violence or illegal activity, content that defames or threatens a real person, content that infringes intellectual property, content that promotes self-harm or suicide, or spam.
We use automated moderation on every input and output. Flagged generations are rejected. Repeated violations may result in your account being permanently barred from the service.
6. Credits, subscriptions, and purchases
The app uses an in-app credit system. You receive a starter credit grant on first use and a daily reload. You can earn more credits by watching ads or buy them as one-time packs or by subscribing.
- One-time credit packs — credits never expire and persist across reinstalls when signed in with Google.
- Subscription credits — granted monthly with your subscription; unused subscription credits expire at each renewal.
- Refunds — handled by Google Play under their refund policy. We honour any refund Google issues; the credits will be reversed.
You must sign in with a Google account before completing a purchase, so the purchase is bound to your account and survives reinstalls.
7. Ads
The free tier is supported by advertising via Google AdMob. By using the free tier you agree to receive ads. EU / UK / CH users see a consent dialog and can opt out of personalised ads.
8. Third-party services
The app relies on third-party AI services (OpenAI, Cloudflare Workers AI) and infrastructure (Cloudflare, Google Firebase, Google Play Billing, Google AdMob, PostHog). Your use of the app is also subject to those services' terms.
9. Intellectual property
The app, its name, logo, and original assets are owned by FlxCode. The app's code is private — you may not decompile, reverse-engineer, or redistribute it without written permission.
Bundled gameplay clips, music, fonts, and SFX are used under their respective licences.
10. AI-generated output disclaimer
AI-generated text and images can be inaccurate, offensive, biased, or in poor taste. We do not endorse and are not responsible for AI-generated output. You are responsible for what you do with it — including any reposting to TikTok, Instagram, YouTube, or elsewhere.
11. Termination
We may suspend or terminate your access at any time, with or without notice, for breach of these terms.
12. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) USD $10 OR (B) THE AMOUNT YOU PAID FOR ANY ACTIVE SUBSCRIPTION IN THE 30 DAYS BEFORE THE CLAIM AROSE.
14. Governing law
These terms are governed by the laws of Italy. Disputes will be resolved in the courts of Milan.
15. Changes
We may update these terms. Material changes will be announced in-app. Continued use constitutes acceptance.
